Minimum 9% and salary sacrifice eligibility

I was told that from March 2009, if my employer wasn’t in a union he doesn’t have to pay an employee's superannuation directly to their super fund, but instead needs to pays it into their wage for individuals to contribute themselves. Is this true? - Anonymous

Superannuation Guarantee employer contributions (the minimum 9% super) must be paid by the employer to a complying super fund for all eligible employees. The employer's membership of associations is not relevant to their legal responsibility to pay Superannuation Guarantee contributions.

Salary sacrifice contributions are different. Employers are not required to allow members to salary sacrifice to super. If an employer rejects a salary sacrifice application, you may need to consider making voluntary contributions from your after-tax pay.
